Terms of Service

1. Acceptance of Terms

By creating an account or using Tenura (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms form a legal agreement between you and Tenura (“we,” “us,” or “our”).

2. The Service

Tenura is a property management platform designed for independent landlords and property managers. The Service includes tools for tracking properties and units, managing tenants and leases, collecting rent online, tracking maintenance requests, logging expenses, and generating reports.

We reserve the right to modify, suspend, or discontinue any feature of the Service at any time with reasonable notice.

3. Account and Free Trial

You must create an account to use Tenura. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

New accounts include a 14-day free trial with access to most features. No credit card is required to start a trial. At the end of the trial period, your account will be restricted unless you upgrade to a paid plan.

You must provide accurate information when creating your account. Accounts used for fraudulent or abusive purposes will be terminated.

4. Payment Terms

Paid plans are billed in advance on a monthly or annual basis. All payments are processed securely through Stripe. By subscribing, you authorize Stripe to charge your payment method on a recurring basis.

Subscription fees are non-refundable except where required by applicable law. If you cancel your subscription, you will retain access through the end of your current billing period.

We may change our pricing with 30 days' notice. Continued use after the effective date constitutes acceptance of the new pricing.

5. Landlord Responsibilities

You are solely responsible for ensuring that your use of Tenura complies with all applicable laws, including but not limited to:

  • Fair housing laws and anti-discrimination regulations
  • Local landlord-tenant laws, including required disclosures
  • Data privacy regulations applicable to the tenant information you collect
  • Payment processing regulations applicable to rent collection

Tenura is a software tool. We do not provide legal advice, and use of the Service does not constitute legal compliance. Consult a qualified attorney for legal guidance on landlord-tenant matters.

6. Tenant Data Handling

When you use Tenura to manage tenant information, you act as the data controller and Tenura acts as a data processor. You are responsible for having the appropriate legal basis to collect and store your tenants' personal data.

You must inform your tenants that their information is managed through Tenura and must comply with applicable data protection laws regarding tenant data. Do not enter false or unauthorized personal information about tenants.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to other users' accounts or data
  • Reverse engineer, decompile, or attempt to extract source code from the Service
  • Use the Service to harass, threaten, or discriminate against tenants
  • Resell or sublicense access to the Service
  • Interfere with the security or integrity of the Service

8. Intellectual Property

Tenura and its content, features, and functionality are owned by us and protected by copyright, trademark, and other laws. You may not copy, modify, or distribute any part of the Service without our written permission. You retain ownership of the data you enter into Tenura.

9. Disclaimer of Warranties

The Service is provided “as is” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

To the fullest extent permitted by law, Tenura shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

Our total liability to you for any claims under these Terms shall not exceed the amounts you paid us in the 12 months preceding the claim.

11. Termination

You may cancel your account at any time from your billing settings. We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or fail to pay applicable fees.

Upon termination, your access to the Service will cease. We will retain your data for 90 days following cancellation before deletion, unless you request earlier deletion.

12. Governing Law

These Terms are governed by applicable law. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction, as applicable.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
